Introduction

TouchProActive respects your right to the privacy of the personal information you provide us. We are a non-anonymous community site. We ask members to make their real names known to each other when logged in to our system and communicating with one another. We seek to provide this non-anonymous social environment while treating your privacy with respect and care.

To that end, unless you designate otherwise or we state otherwise in this policy or at the time information is collected, with the exception of using your real name and your country of residence (as described), any personal information you provide to TouchProActive will be known only to two parties: you and the staff of TouchProActive. Your name and your country of residence will be available to other members for purposes of community participation. However, we will not disclose the fact of your membership by name to non-members without your permission, except in specific situations such as to law enforcement agencies as specified in this document.

The following policy is intended to explain how your personal information will be treated as you make use of our sites and their features. Personal information includes your address, telephone number, street, email address, billing information, click-through and usage activity and any other personal information you may provide. This policy may change from time to time, with details being posted on the Announcements Board in the Community area of the site. Please check there periodically.


Announcements and Spam

At the time of registering for their memberships, TouchProActive subscribers receive an email containing a password giving them access to the site. Subscribers also receive weekly emails from TouchProActive announcing the latest issue of the online newsletter. From time to time, members may receive notification of new services, changes to policies or annual membership price adjustments. We will not send you other email at the address you provide, except for infrequent communications to resolve issues that may arise in connection with your TouchProActive account. More routine announcements are made in the TouchProActive Discussion Boards rather than via email.

We will not sell, rent or give your email address to any third party. The email address you use to register with TouchProActive will remain private, unless you choose to make it public when participating in the Discussion Boards/Private Messaging/Chat areas of the site.
We do not permit the use of member email addresses or other information for any solicitations including sending unsolicited commercial email.


Traffic data

Each time a visitor comes to TouchProActive, our servers - like most on the Web - collect some basic technical information, including, for example, the visitor's domain name (e.g., whether the user is logged on from aol.com or yahoo.com), referral data (e.g., we record the address of the last URL a user visited prior to clicking through to the TouchProActive Web site and browser and platform type (e.g., an internet Explorer browser on a PC platform).

We also count, track and aggregate the visitor's activity into our analysis of general traffic flows at our sites (e.g. tracking where traffic comes from, how traffic flows within the TouchProActive site.) To these ends, we may merge information about membership levels and activity into group data, which may then be shared on an aggregated basis with investors or the public; but we will not disclose your individual identity or personally identifiable data without your permission. When we do present any form of aggregated information to outside parties, no one will be able to identify you or contact you.


Participants

TouchProActive members are expected to comply with our Terms of Service and with the Ground Rules laid out in the Community Center. We cannot control third parties' use of information you may choose to provide via the Community Center or in your user home page (should you choose to display it.). Sharing information with other TouchProActive members is a matter of individual choice and judgment. If you choose to take part in the TouchProActive Discussion Boards, live conferencing or in the non-private area of the Chat room, whatever you may disclose will be readable by other TouchProActive members.


Use of Cookies

A cookie is a small amount of data that is sent to your browser from a Web server and stored in your computer's memory or written on your computer's hard drive. We use session cookies, non-persistent files which vanish when you shut down your browser, to allow the system to know you have already entered a password each time you click for more data in the member-only areas. Our cookies do not contain any of the personal information you have provided to us. Information about when you were last present is available to other members of the system in the Discussion Boards to which you have mutual access so that it is easier to tell who is up to date in a group conversation. We never provide this information on your activity to non-participants.


Newsletter Sign-up Information

In order to receive the TouchProActive newsletter, subscribers provide TouchProActive with personal information including name, e-mail address, postal code, and country of residence.


Billing Information

In order to become a paying member, users provide TouchProActive with personal information including a telephone number, billing street address and credit card information. TouchProActive goes to great lengths to keep all such information strictly confidential and does not reuse, resell or redistribute it in any way. This information is not available to other TouchProActive members unless members disclose it in their members profile or in their participation in the Community area of the site.


Our commitment to children's privacy

Protecting the privacy of the very young is important to us. For that reason, we do not collect or maintain information at our Web sites from those we actually know are under 13, and no part of our Web site is structured to attract anyone under 13.


Disclosure of personal information

TouchProActive will not otherwise use or disclose your personal information without your consent except (i) as described in this privacy policy, or (ii) as required by law. Any subscriber whose information is sought in accordance with this policy will be advised of the inquiry as soon as practical. Notification of such inquiries will be emailed to members before disclosures are made, unless notification is prohibited by law.

This privacy policy may not protect information you voluntarily disclose to others via a post to any online conference, email list, chat or send tool or any other communication environment within or from our service.

Third party Disclosure
Legal Rights:
We may disclose Personally Identifiable Information in special circumstances when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Service, or to protect the safety and/or security of our users, our Website or the general public.

Outside Contractors:
We may employ independent contractors, vendors and suppliers (collectively, "Outside Contractors") to provide specific services and products related to our Website, such as hosting and maintaining our chat rooms, providing credit card processing and fraud screening, and developing applications for our Website and e-mail services. These Outside Contractors may sometimes have limited access to information collected on our Website, including your Personally Identifiable Information, in the course of providing products or services to us. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary in order for the Outside Contractors to perform their limited function for us. We also require that these contractors (i) protect the privacy of your Personally Identifiable Information consistent with this Privacy Policy, and (ii) not use or disclose your Personally Identifiable Information for any purpose other than providing us with products or services for which we contracted.

Third Party Sellers:
In addition, through our Website, you may be given the opportunity to purchase or to obtain more information regarding certain content, products or services which are sold through a person or company other than us, for example through our Classifieds or vendors such as Amazon.com. We will attempt to make it clear to you when you are dealing with a Third Party Seller by opening a new browser or otherwise notifying you that you are leaving our Website. For example, if you see a phrase such as "powered by" or "brought to you by" followed by the name of a person or company other than TouchProActive, then you are likely on, or about to enter, a website hosted or operated by a person or company other than us. Third Party Sellers may request that you submit certain information to them in order to purchase their products or services or to obtain additional information from them. You do not need to submit this information or purchase any products or services from Third Party Sellers to access our Website. By submitting the requested information, you affirmatively consent to have that information shared with the Third Party Seller. This information may be subject to a different privacy policy. We do not otherwise share or disclose your Personally Identifiable Information to Third Party Sellers.

Sale of Business:
We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of TouchProActive provided that the third party agrees to adhere to the terms of this Privacy Policy. We will notify users of any such transfer through notice on our site and through email.


Cancellation and data removal policies

If you would like to end your membership and to delete any data we are not required to retain for accounting purposes, you can close your account and request data removal from admin@TouchProActive.com. In accordance with the TouchProActive recourse policy you will be entitled to a refund on the unused portion of your membership.


Other sites

TouchProActive contains links to other sites on the Web. We cannot control and are not responsible for the privacy practices or content of such other Web sites.
